Resisting Officer Without Violence
Defined as:
  • Knowingly resisting, obstructing or opposing;
  • A law enforcement officer who was engaged in the lawful execution of a legal duty. 
Penalties:
  • Resisting Officer Without Violence is a misdemeanor of the first degree, punishable by up to 1 year in jail & no more than a $1,000 fine. - Section 843.02 of the Florida Statutes
Resisting Officer With Violence
Defined as:
  • Knowingly and willfully resisting, obstructing or opposing;
  • A law enforcement officer who was engaged in the lawful execution of a legal duty; BY
  • Offering or doing violence to the person of such officer.
Penalties:
  • Resisting Office With Violence is a felony of the third degree, punishable by up to 5 years in prison & no more than a $5,000 fine. Section 843.01 of the Florida Statutes.
