What is a Violation of Probation in Florida?
Section 948.06, Florida Statutes
If at any point in time during your probationary term, your probation officer has reason to believe that you have violated a term or condition of your probation, they will author a sworn affidavit and request that your Judge either issues a warrant for your arrest or a notice to appear for court. The maximum possible punishment for a violation of probation is same as the maximum punishment you could have received for the underlying offense that you went on probation for.
What Happens at a VOP Hearing?
At your first court hearing for a violation of probation, here is what could potentially happen: (1) you could admit to violating your probation. If you do this, the court can revoke, modify, or continue your probation. If the Judge revokes your probation you could potentially be sentenced to the maximum penalty permissible for the offense you are on probation for; (2) you could deny violating probation and demand a hearing with witnesses; or (3) the Judge can dismiss the violation.
