Soliciting Another to Commit Prostitution
Defined:
  • It is unlawful to solicit, induce, entice, or procure another to commit prostitution, lewdness or assignation. Section 796.07(2)(f) of the Florida Statutes.
  • "Prostitution" means the giving or receiving of the body for sexual activity for hire but excludes sexual activity between spouses. Section 796.07(1)(b) of the Florida Statutes. 
Penalties:
  • Soliciting Another to Commit Prostitution is a misdemeanor of the first degree, punishable by up to 1 year in jail & no more than a $1,000 fine.
  • Additionally, the court SHALL order a person convicted of Soliciting Another to Commit Prostitution to:
    1. Perform 100 community service hours;
    2. Pay for and attend an educational program about the negative effects of prostitution and human trafficking; AND
    3. Pay a $5,000 civil penalty.​

Soliciting Another to Commit Prostitution is an "enhance-able" offense:
  • For a second violation, the charge is enhanced to a felony of the third degree, punishable by up to 5 years in prison & no more than a $5,000 fine.​
  • For a third or subsequent violation, the charge is enhanced to a felony of the second degree, punishable by up to 15 years in prison & no more than a $10,000 fine.
