Soliciting Another to Commit Prostitution
Defined:
-
It is unlawful to solicit, induce, entice, or procure another to commit prostitution, lewdness or assignation. Section 796.07(2)(f) of the Florida Statutes.

"Prostitution" means the giving or receiving of the body for sexual activity for hire but excludes sexual activity between spouses. Section 796.07(1)(b) of the Florida Statutes.
Penalties:
-
Soliciting Another to Commit Prostitution is a misdemeanor of the first degree, punishable by up to 1 year in jail & no more than a $1,000 fine.

Additionally, the court SHALL order a person convicted of Soliciting Another to Commit Prostitution to:
-
Perform 100 community service hours;

Pay for and attend an educational program about the negative effects of prostitution and human trafficking; AND
-
Pay a $5,000 civil penalty.​

Soliciting Another to Commit Prostitution is an "enhance-able" offense:

For a second violation, the charge is enhanced to a felony of the third degree, punishable by up to 5 years in prison & no more than a $5,000 fine.​

For a third or subsequent violation, the charge is enhanced to a felony of the second degree, punishable by up to 15 years in prison & no more than a $10,000 fine.
